Conclusion:
September 16, 2021 - This inspection was completed as PACFA Inspectors accompanied Animal Law Enforcement Officers as
they executed a search warrant.
In addition to numerous PACFA violations observed, there were 5 dogs observed to be in need of immediate vet care, who
despite a vet being on the property had not received necessary care.
Because it was a sweeping warrant to cease sick animals and none of the officers or inspectors appear to have veterinary experience one of the Humane Societies seven veterinarians should have been brought to the inspection. They would have known that best practices is to see contagious animals after seeing healthy animals when possible so disease is not spread to healthy animals. 

All of the animals in question were receiving prescribed medical care twice a day under the direction of our licensed veterinarian. Two of the dogs had symptoms of kennel cough and were improving. They were housed in separate isolation rooms to insure there was no cross contamination. There was no need for the veterinarian to see them before he was done with healthy animals. They were on the procedure board to be seen by the veterinarian.

Two dogs had diagnosed distemper. They were both showing signs of improvement, they were monitored that morning and our veterinarian was scheduled to see them after taking care of healthy animals. They had already received their morning medications.

The vet and vet tech admitted to administering prescription medications without written direction, and without the vet
having physically examined the animals himself. This is opposite of the truth. Watch this video to see for yourself. 
This was the facility's 6th failed inspection since August of 2020. The inspection report was provided via email. At this time
the facility has been referred to the administration due to continued failed inspections, pending animal cruelty charges,
evidence the licensee and staff are practicing veterinary medicine without a license, and the potential of additional animal
cruelty charges for the 5 dogs seized by Animal Law Enforcement during their search warrant.

19.1 Each licensee must keep and maintain records in the form and manner designated by the Commissioner as
set forth by these rules. The licensee must maintain requisite records at the physical facility address specified in
the license application for a period of two years after disposition of the animal for which the record was originally
made. All required records must be made available to any inspector authorized by the Commissioner.

PART 13 Cleaning and Sanitation
13.17 The building and grounds must be kept clean, in good repair, and free of trash and unnecessary or unused
items.
September 16, 2021 - At the time of the inspection, the building and grounds were in need of cleaning. There were
piles of feces throughout the exercise yard. There was an excessive amount of animal hair throughout the building
and the grounds.

13.15 Animal and food wastes, used bedding, debris, and any other wastes must be removed from the pet animal
facility daily and must be removed from the premises weekly or more frequently as necessary to control
infestation, odors, disease hazards, and nuisances.
September 16, 2021 - At the time of the inspection, there was dirty bedding in the shed next to the kennels. The
deceased puppies observed in the freezer on August 10, 2021, were still in the freezer. One of the puppies was
documented as being euthanized for parvo in June of 2021, yet the facility had not removed the remains from the
facility. The facility was not cleaning feces from the outdoor exercise yard as required. Both healthy and sick animals
were being allowed to access the area with urine and feces from both remaining in the yards. The outside also had a
build up of animal hair throughout.

13.1 Sanitation of a facility may be achieved only by using one of the two methods listed below: 13.1.1. “Chemical
Sanitation” means the application of a Disinfectant, per the manufacturer’s label instructions, to a clean surface;
or 13.1.2. “Heat Sanitation” means the application of heat to raise surface temperature to at least 160 degrees
Fahrenheit.

13.2 All enclosures, cages, benches, tables, tubs, etc., must be cleaned and then sanitized/disinfected after any
one animal or group of animals ceases to occupy the space and before any other animal or group of animals
occupies the same space or more often if necessary to maintain clean and sanitary conditions.

13.9 All pet animal enclosures, cages, runs, isolation rooms, or areas that contain pet animal(s) (except fish)
suspected or being treated for communicable disease must be cleaned and sanitized daily. Fish enclosures must
be cleaned and treated as appropriate for the species.

13.10 Cross-contamination in isolation areas must be minimized by limiting handling of the animals and taking
precautions to prevent contaminating other animals.
September 16, 2021 - At the time of the inspection, the facility had animals with diagnose distemper and distemper
symptoms housed in 3 separate areas of the facility. They were allowing two of the dogs with distemper to exercise
in the same yard where healthy animals are exercised.

PART 14 Classification and Separation
14.2 Pet animals suspected of having a communicable disease must be isolated from other susceptible animals
and the public.
September 16, 2021 - At the time of the inspection, the facility had at least 4 dogs with possible distemper who
were housed in 3 separate areas of the facility. Two fo the dogs with the worst symptoms were being allowed to
exercise in the same outdoor area as the healthy dogs.

PART 18 Special Requirements
18.18 In animal shelters each animal must be identifiable through cage/run cards, identifying collars, leg bands, or
alternate methods of identification approved by the Commissioner.

September 16, 2021 - At the time of the inspection, there were kennels that did not have cage cards that allowed us
to identify the animals in the enclosures. Other kennels had multiple cage cards that did not appear to match any of
the animals in the enclosure. One had cage cards for staff dogs, yet staff dogs were being housed in the office area.

PART 16 Isolation
16.5 Cross-contamination during cleaning of isolation areas must be minimized by limiting direct contact between
animals, limiting handling of the animals, and taking precautions to prevent contaminating other animals.
September 16, 2021 - At the time of the inspection, Staff stated that they cleaned the Tuff Shed in the evening so
they did not contaminate the building, but admitted that while they cleaned they allowed dogs with distemper to
visit with an adopter and socialize with one another in the outdoor exercise area where healthy dogs are exercised.

PART 15 Veterinary Care and Disease Control
15.3 Sick, diseased, or injured animals, except for fish and invertebrates, must be provided with timely veterinary
care or euthanized in a humane manner under the direction of the facility’s veterinarian. Euthanasia must be
consistent with § 35-80-102(7), C.R.S.
September 16, 2021 - At the time of the inspection, there were several dogs who were in need of immediate
medical attention. They had not seen a vet since 9/2/21 even though they had continued to decline and/or have
unaddressed health issues. 5 dogs, 4 with presumed distemper, and 1 with visible injuries were seized by Animal Law
Enforcement.

15.7 Prescription medication, including prescription bathing products, may only be administered to pet animals
under the written direction of a licensed veterinarian.
September 16, 2021 - At the time of the inspection, Dr. Smith admitted to having only verbally directed staff to
administer prescription medications to animals. Some of the animals he had never seen in person and was relying on
vet tech Haley Kemp to explain symptoms for his diagnosis.

PART 11 Physical Facility Standards
11.2 In animal shelters and retail/wholesale facilities all indoor building surfaces must be water-resistant and
capable of being readily cleaned and sanitized.

and were incapable of being cleaned and sanitized as required.

11.8 Pet animal areas must be adequately ventilated with fresh or filtered air to minimize odors and moisture and
to provide for the health and comfort of the animal at all times. Ventilation may be mechanical or natural.
September 16, 2021 - At the time of the inspection, the facility had a strong odor of urine and feces. The sewer cap
in one room was open allowing vapors from the sewer to enter the room.

PART 10 Inspections
10.2 All licensees or applicants for licensure or license renewal must make their facilities, animals, and records
available to the Commissioner for inspection during regular business hours. The licensee or applicant must also
provide the inspector with sufficient space to examine records and write the inspector's report. If the licensee's or
applicant's facilities, animals, procedures, or records do not meet the requirements of PACFA or these rules, the
licensee or applicant will be advised in writing of existing deficiencies and the corrective measure that must be
performed in a timely manner to be in compliance with PACFA and these rules. The licensee or applicant must
submit a written correction report within 20 days of receiving the inspection report. Failure on three (3)
inspections within any twelve month period will constitute a separate violation.

PART 19 Recordkeeping
19.2 Acquisition records are required and must include, at a minimum: the date the animal was transferred;
source or how acquired; name, address and phone number of the source if known; number of animals received;
animal breed or species; specific identifying characteristics if available; bird band number or other identification
approved by the Commissioner, if applicable; date of birth of dogs, cats, hamsters, rabbits, and guinea pigs.
September 16, 2021 - At the time of the inspection, the facility had accepted a dog back from an adopter to provide
care for distemper, but it was not clear who the legal owner of the animal was. Another dog with distemper on the
property was documented as being adopted by the licensee on 9/3, yet per staff had been at the facility with
distemper for over a week with staff being unclear on who the legal owner of the dog was. Both of these dogs were
seized by Animal Law Enforcement as both were in need of immediate vet care.

19.9.4 Treatment records must be kept on all pet animals (except fish and invertebrates) that receive any
medications or immunizations used in the treatment or prevention of illness, or the treatment of injury, while in
the care of the pet animal facility. These records must include the identification of the pet animal receiving
medical treatment, signs of illness, reason for medical treatment, or veterinary diagnosis, the name of the
medication or immunization used, the amount of medication used, and the time and date on which the
medication or immunization was administered.
September 16, 2021 - At the time of the inspection, the two dogs in the shed had been being given a throat spray for
coughing. This spray was not documented on their treatment records.

PART 17 Food and Water
17.1.1 Pet animals must be fed in a manner that is consistent with the nutritional needs for the age, size,
condition, and species.
September 16, 2021 - At the time of the inspection, there were two dogs with distemper housed in a Tuff Shed. The
dogs had a BCS of 1. Staff had been bowls of a wet food mixture in the kennel even though the food had been
untouched. Staff admitted that the little food the dogs did intake was vomitted or went through them but had not
made any changes to diet or had the dogs seen by a vet to address the weight loss.
